I have a fresh build from latest download on following instructions themes fail to load cant select another theme from admin page or activate a theme.......

As I can see from the error log, there are some issues with permissions for the ow_static/themes directory. Try setting them to 777, it might help.

yes I saw that and changed it they were owned by deamon all other rights are read only.
if you chmod 777 them soon as you refresh a web page they revert back to deamon read/write only....?

Looks like some security settings of your hosting server. Consider about contacting them.
