the person that posts photos can make them private for just friends

it is set just friends but newsfeed album shows them.

Steve, how did you upload that photo? in the newsfeed or via photo plugin?

yes uploaded photo thru iphone via newsfeed. All settings are my friends, the photo doesn't show up in the website newsfeed but it does show up in recent photos on main page and on photo page for all to view.

all model photo's should be private but they are not.

The privacy issue has been fixed. Updated plugin is in the store. The notification will appear in your admin panel within next 24 hours.
